FIRST:

Bensa Global, available at www.bensaglobal.com, is a company dedicated to offering the service of transporting non-negotiable documents, packages of any kind, or corporate cargo belonging to the client between the company’s warehouses in the United States, China, Colombia, or any other source from which the service is provided. These cargoes are shipped by air, sea, or land to the client’s address in Costa Rica, or vice versa, in the case of exports.

By using or accessing www.bensaglobal.com, the sender and any other interested party agree to the terms of use contained herein, which are subject to change without prior notice to the parties.

SECOND:

The sender or correspondent designated by the customer in the United States, China, or any other source is responsible for shipping the goods to the service company’s warehouses in Miami, China, or another source. The delivery time and the means used to achieve this are the sole decision of the sender or correspondent, with Bensa Global having no influence on these decisions or assuming any liability for delays or non-compliance caused by these parties.

THIRD:

The purpose of the service is to facilitate the customer’s acquisition of goods of a different nature, in which they are interested. The seller of the goods or a third party designated by the customer will deposit the purchased goods in the company’s warehouses in the United States, China, or any other source, addressed to the customer in Costa Rica. To this end, it is essential that the customer, once they have selected the item, provide their supplier, seller, or third party with the personalized address assigned by Bensa Global to receive the goods within the country of origin.

FOURTH:

Bensa Global reserves the right to use the most appropriate means of transportation, whether air, sea, or land, protected by international regulations (IATA, International Trade, among others). All shipments must comply with international regulations and the requirements of authorities in the U.S., China, any other country of origin, and Costa Rica. The shipment of money, narcotics, high-risk chemicals, radioactive substances, weapons, ammunition, drugs, and any item that poses a risk is prohibited. Bensa Global will not ship in violation of these laws. The customer assumes full legal responsibility if their merchandise violates these regulations and releases Bensa Global from any repercussions.

FIFTH:

The company may conduct a physical inspection of packages at origin to ensure compliance with customs regulations and requirements. It is the customer’s and the sender’s responsibility to deliver the merchandise complete, packaged, and with a commercial invoice to the indicated warehouse. Bensa Global will not be responsible for shipments that have unclear or incorrect addresses. Once the merchandise is received, the customer in Costa Rica will be notified of the quantity, weight, and volume of the packages. If there are no complaints, the shipment will be assumed to be complete and correct.

SIXTH:

Bensa Global guarantees the regular delivery of packages and cargo from the United States, China, or other origins to Costa Rica, subject to compliance with legal and customs requirements. The customer agrees that authorities may inspect packages, and in the event of irregularities, delivery may be suspended or delayed. Bensa Global will not be liable for damages or delays caused by such situations.

SEVENTH:

Bensa Global will not be liable for delays caused by customs procedures or incidents beyond its control (strikes, terrorism, work stoppages, natural disasters, among others). Likewise, it is exempt from liability in the event of unforeseen circumstances or force majeure.

EIGHTH:

Bensa Global acts as the customer’s representative before the service company at Costa Rican Customs, and must comply with the provisions of the General Customs Law and its Regulations.

NINTH:

The customer must comply with the weight and volume limits established by the airlines or shipping companies. Bensa Global is released from contractual liability in the event of delays resulting from excess cargo.

TENTH:

Merchandise subject to permits or technical notes will remain in custody in bonded warehouses until the respective procedures are completed. This also applies to high-value or special products while taxes are paid.

ELEVENTH:

The customer acknowledges that shipments are sent in sealed envelopes, boxes, or pallets in good condition. The contents are the customer’s sole responsibility and are subject to current national and international regulations.

TWELFTH:

Bensa Global will not be responsible for merchandise held by Customs. Release will occur after taxes and storage fees have been paid. These amounts must be paid by the customer at the time of pickup. Failure to pay these amounts will entitle Bensa Global to retain the shipment until this requirement is met.

THIRTEENTH:

Bensa Global will verify the condition of the packaging and the weight of the packages. If visible damage is detected, the customer will be informed, and they must authorize the opening of the package in writing to verify its condition. This process will have an additional cost of $10.00 and will be documented photographically.

FOURTEENTH:

Any shipment with discrepancies and without clear instructions will be sent to San José without liability for Bensa Global. The customer will assume the freight costs.

FIFTEENTH:

The customer may request cargo insurance at the time of purchase by completing the corresponding form and presenting the invoice or voucher. The insurance will cover 100% of the item’s value and its cost will be charged at the time of delivery.

SIXTEENTH:

If the customer does not purchase cargo insurance, Bensa Global will not be responsible for damages or losses attributable to its operation.

SEVENTEENTH:

Deliveries within the Greater Metropolitan Area (GMA) will have a shipping cost of $6. Deliveries outside the GMA will have an additional cost of $3 plus the rate of the courier company chosen by the customer.

EIGHTEENTH:

Claims Management and Refund Guarantee

Bensa Global will make reasonable efforts to meet standard transit times of 5 to 7 business days, but does not guarantee this timeframe. Bensa Global is not responsible for delays caused by airlines, customs, weather, strikes, riots, or other unrelated causes.

Bensa Global offers protection against loss, theft, damage, or mishandling of the package. Compensation will be transferred to the customer’s bank account within a reasonable period of time after the investigation is completed, provided the results justify the compensation. This does not include operating costs such as insurance, delivery, warehousing, and repackaging.

NINETEENTH:

In the event of an incident at the Bensa Global warehouse, the customer must present proof of delivery, proof of ownership, and an invoice for the package. The claim period is 8 calendar days from the date of notification.

In addition, for all packages received at our warehouse in San José, the customer will be given 30 calendar days to collect them. After this period, the shipment will be destroyed, with no claims or compensation.

TWENTIETH:

The customer may choose the means of transportation if previously agreed upon or if Customer Service is notified.

TWENTY-FIRST:

The website www.bensaglobal.com may contain links to third-party websites, whose privacy policies may differ. Bensa Global has no control over such sites, nor is it responsible for their quality or content. Users access these sites at their own risk and should read their policies.
